Terms of Service

The rules for using Unfault, written to be readable.

These Terms of Service ("Terms") govern your access to and use of unfault.dev, the Unfault hosted services, and related tools (collectively, the "Service").

These Terms govern your access to and use of the Unfault website (unfault.dev), the Unfault application (app.unfault.dev), and any related subdomains or services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Unfault is currently operated as an individual project. This section will be updated if and when a legal entity is created.

2. What Unfault provides

Unfault is a developer tool designed to help you understand how code affects behavior by generating and querying derived analysis artifacts such as call graphs, findings, and summaries.

  • The Unfault CLI and editor extensions perform analysis locally by default.
  • Some features (accounts, session storage, querying, and related services) use Unfault's hosted infrastructure.

Your use of the Service is also governed by our Privacy Policy, which explains how personal data is processed.

3. Eligibility and accounts

You must be legally capable of entering into a binding agreement to use the Service.

If you create an account, you agree to:

  • provide accurate and complete information,
  • keep your credentials secure,
  • be responsible for all activity under your account.

We may use a third-party authentication provider to manage sign-in and access control.

4. Pre-launch access and future plans

4.1 Pre-launch (design partner access)

During the pre-launch period, the Service may be provided at no charge to individual design partners. Billing is not enabled during this period.

We will not charge fees unless we have explicitly agreed to paid terms with you in writing.

4.2 Future paid plans

We may introduce paid plans in the future. If we do, we will clearly communicate pricing and terms in advance and give you the option to opt into a paid plan.

Unless required by law or explicitly agreed otherwise, fees for paid plans are non-refundable.

5. Your content and responsibilities

5.1 Your content

You are responsible for the code, repositories, and other data you analyze using Unfault. You represent that you have the necessary rights to use such content and that your use of the Service complies with applicable law and third-party obligations.

5.2 Local-first processing

Unfault is designed so that raw source files are processed locally by default. As part of standard operation, raw source files are not uploaded to Unfault servers.

If you choose to persist analysis sessions, the Service may store derived artifacts (for example: structural graphs, findings, summaries).

5.3 Feedback

If you provide feedback, ideas, bug reports, or suggestions, you grant Unfault a non-exclusive, worldwide, royalty-free license to use that feedback to improve the Service, without obligation to you.

6. Acceptable use

You agree not to:

  • access or attempt to access the Service or systems in an unauthorized manner,
  • interfere with or disrupt the Service, including by probing, scanning, or overloading infrastructure,
  • introduce malware or conduct attacks through the Service,
  • misuse or reverse-engineer hosted components except as permitted by law,
  • use the Service in violation of applicable export control or sanctions laws.

We may suspend or restrict access if we reasonably believe your use violates these Terms or poses a risk to the Service or other users.

7. Open source and licensing

7.1 Open source components

Certain Unfault components, including the CLI and editor extensions, may be released under open source licenses such as the MIT License. Those licenses govern your rights to those components.

7.2 Service and branding

The hosted Service, website, documentation, and branding are owned by Unfault or its licensors and are protected by intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not use Unfault's name or logo in a way that suggests endorsement without permission.

8. Availability and changes

We aim to keep the Service available, but it may occasionally be unavailable due to maintenance, outages, or factors outside our control.

We may modify or discontinue parts of the Service. If changes materially affect your use, we will make reasonable efforts to provide notice.

9. Beta and experimental features

Some features may be offered as alpha, beta, or preview features. These features are provided "as is", may change or be removed at any time, and may have limited support.

10. Termination

10.1 By you

You may stop using the Service at any time. You may request account deletion by contacting us, or via account controls if available.

10.2 By us

We may suspend or terminate your access if:

  • you violate these Terms,
  • your use creates risk or harm to the Service or other users,
  • we are required to do so by law.

Where reasonable, we will attempt to provide notice.

11. Disclaimers

The Service is provided "as is" and "as available".

Unfault does not warrant that:

  • the Service will be uninterrupted or error-free,
  • analysis outputs will be complete or accurate,
  • results will identify all issues, risks, or behaviors,
  • outputs are suitable for any specific purpose.

You are responsible for how you interpret and use information produced by the Service.

Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law:

  • Unfault will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data, arising out of or related to the Service.
  • Unfault's total liability for any claims relating to the Service is limited to the amount you paid to Unfault for the Service in the 12 months preceding the event giving rise to the claim, or €100 if you have not paid anything.

Nothing in these Terms limits liability for fraud, wilful misconduct, or liabilities that cannot be limited by law.

13. Indemnification (business use)

If you use the Service on behalf of a business or professional activity, you agree to indemnify and hold Unfault harmless from claims arising out of your use of the Service, your violation of these Terms, or your violation of third-party rights, to the extent permitted by law.

14. Governing law and jurisdiction

These Terms are governed by the laws of France.

You agree to first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved, it will be subject to the jurisdiction of the competent courts of Rennes, France, unless mandatory law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and may provide additional notice for material changes. Continued use of the Service after changes take effect constitutes acceptance.
